description Article: 1 A new article sub no. (Two bis) shall be added to Law No. 4 of the year 1996 concerning the application of the Civil Code to premises that have not been previously leased and those whose lease contracts have expired or will expire without any party having the right to remain therein. The text of which is read as follows: (Article-2-Bis): The tenant or their general or specific successor, as the case may be, shall vacate the leased premises and return it to the owner or lessor, as the case may be, at the end of the term specified in the lease contract. In the event of refusal to vacate, the owner or lessor may request the summary judge at the court having jurisdiction over the property to issue an eviction order against the party refusing to vacate, without prejudice to the right to claim compensation if applicable. Without prejudice to the provisions of the first paragraph of this article, the tenant or their general or specific successor, as the case may be, may file a substantive lawsuit before the competent court following the usual procedures. However, the filing of such a lawsuit shall not result in the suspension of the eviction order issued by the above-stated summary judge. Article: 2 This Law shall be published in the Official Journal and shall enter into force on the day following the date of its publication. This Law shall be sealed with the seal of the State and enforced as one of its laws.
